ASB offender remanded to prison

We know the impact that anti-social behaviour (ASB) has on individuals and community safety, this is why we take it so seriously.  Last week a community in Wigan finally had respite, following a positive outcome in court which has resulted in the perpetrator being remanded in prison for his actions.

For the past 12-months, the actions of one individual had created misery for a close-knit community.  The perpetrator, a Torus tenant, has been targeting his neighbours with abuse and threats.  With support from the victims, who provided witness statements in May, we secured an emergency injunction against the offender with power of arrest, followed in June, by a final  anti-social behaviour injunction and power of arrest for 12 months.

Despite the injunction, being arrested for breaching the injunction and appearing before the court again, the perpetrator continued to target neighbours with violent threats.  He ignored bail conditions, resulting in an arrest warrant being issued, and continued to attempt avoiding arrest.

Working directly with Police and the courts, an arrest warrant was executed which resulted in the perpetrator being brought before the court once again, but this time the court refused bail and remanded him into prison until further hearing, thanks in part to the witness statements from his neighbours.

“This was a particularly unpleasant ASB case and we are so pleased with the outcome we have received, both for Torus and the community who have bravely supported the case.

“The evidence provided by the residents on how the ongoing behaviour was severely impacting their lives was vital to bringing this individual to justice.

“There’s a lot of work that goes into stopping ASB.  Things can take time. But if you report it to us, you can be sure we’ll do everything we can to stop it and we won’t give up.   To get this result required multiple hearings and partnership working between the Torus Enforcement and the in-house Legal Team, working in partnership with the Police & the Court.”

It is not possible to tackle these issues alone and building good working relationships with partners is key to tackling ASB.  By working together, we can support each other to get the best the results for tenants and those suffering as a result of ASB.

Since the perpetrator was remanded to prison, we have received the following feedback from the neighbours.

 “Thank you for all your help, we finally had a good night sleep last night, it was so peaceful and we were not paranoid about noises.  Our son is also more settled and has enjoyed playing outside the front, which he hasn’t been able to do for a year.”

“A peaceful  night and a worry free morning was wonderful. We would like to take this opportunity to thank Torus for all your understanding.”

Following another hearing this week, the Judge has requested further investigation and information from the perpetrators legal team and he will remain in prison for at least the next three weeks.

Ian, added:

“We were pleased at the result this week and we know the community will be relieved.

“Our hope is that he will remain on remand until a final hearing, but if he is released prior to that date, we shall request he remains subject to the injunction with power of arrest.  Whatever happens, will continue to work as hard as we can to support the community and achieve a positive outcome.”

This was a particularly extreme case of ASB, but we expect our tenants to act reasonably and be considerate of the different values and lifestyles reflected in our neighbourhoods and where the anti-social behaviour is a criminal offence, we encourage those affected by it to report the matter to the police.
